Penalties & Compliance

Penalties, record-keeping and staying compliant

Compliance here is less about a single fine and more about the position you are left in if the Federal Tax Authority looks closely at a period and your invoice data does not stand up. This section covers exposure, records, and the overlaps with VAT and corporate tax that catch people out.

What matters

What you actually need to know

Four things worth understanding properly before you spend money on anything.

1The framework was restructured, so old numbers are unreliable

The UAE tax penalty framework was restructured under Cabinet Decision No. 129 of 2025, effective April 2026. Any figure you read in an older article should be checked before you rely on it.

2Visibility is the real change

Once invoice data flows to the authority in near real time, mismatches between what you invoiced and what you declared become visible without anyone opening a file. That raises the value of getting VAT treatment right at the line level.

3The pilot removes penalty exposure early

Organisations that join the voluntary phase from July 2026 are not exposed to penalties before their official compliance deadline, which is a strong argument for going early rather than waiting.

4Archiving is not the same as having sent it

You need to be able to retrieve invoices, in a form an auditor accepts, for the retention period. A provider moving your invoices is not automatically your archive — confirm which side of the line that responsibility sits on.

Practical steps

Staying on the right side of it

None of this is exotic — it is ordinary discipline applied a little earlier than most businesses apply it.

Questions we get asked

Frequently asked

Short, practical answers. If yours is not here, ask us directly — we answer even if you never become a client.

What are the penalties for not complying with e-invoicing?

The penalty framework was restructured under Cabinet Decision No. 129 of 2025 with effect from April 2026, so specific figures should be confirmed against current guidance rather than taken from older articles. The practical exposure is broader than a single fine: it includes assessment risk where your invoice data and your returns do not reconcile.

Does e-invoicing change my VAT obligations?

Your obligations do not change, but your visibility does. Invoice-level data reaching the authority makes discrepancies between invoices and returns much easier to spot, so accuracy at the line level matters more than it used to.

How long do I need to keep e-invoices?

Standard UAE record retention requirements apply and the practical answer is that you need retrievable records for the full retention period. Confirm whether your provider's archive counts as yours before assuming it does.

GoldenKey e-Invoice · in development

We are building our own e-invoicing app — and the ERP and CRM around it

Most businesses will need something sitting between their sales desk and their Accredited Service Provider — a system that creates a proper structured invoice, holds the customer data the standard demands, and keeps a record an auditor will accept. That is what we build, and because we build it ourselves we can shape it around your business rather than asking you to reshape your business around a product.

Works on mobileIssue and check invoices from a phone — useful for site, showroom and delivery teams.
Hosted or on your own serverRun it on our hosting or inside your own environment if your policy requires it.
Arabic & EnglishDocuments and interface in both, since UAE counterparties ask for both.
Built and supported locallyDesigned and maintained by our own team in the UAE and India — you talk to the people who built it.
Structured invoice outputEvery invoice is produced as structured data mapped to the PINT AE field set, not a PDF with a logo on it.
Connects to your ASPWe wire your system to the Accredited Service Provider you appoint, so the exchange happens through the approved channel.
Full invoicing suiteQuotations, proforma, tax invoices, credit notes, debit notes and part-payments in one place.
Customer & supplier recordsTRN, TIN, licence details, trade name in English and Arabic, and the addresses the schema expects.
Validation before sendingMissing or malformed fields are caught in your own system first, so rejections do not pile up later.

GoldenKey is a business setup and compliance consultancy. We are not a Ministry of Finance Accredited Service Provider, and we do not claim to be one. Our software is built to work alongside the ASP you appoint. Scope, timelines and pricing are agreed in writing before any work starts.
